1. Definitions

  • "AuditStream AI", "we", "us", "our" refers to AuditStream AI, a trading name operated by Jeroen De Backer and Thomas Van der Auwermeulen, Belgium.
  • "Website" means the website accessible at www.auditstream.ai and all its pages.
  • "Free Checker" means the free EU AI Act compliance checker tool available at auditstream.ai/checker.html.
  • "Services" means all products and services offered by AuditStream AI, including the Free Checker, Readiness Scan, Guard plan, and Governance plan.
  • "User", "you", "your" refers to any person accessing the Website or using the Services.
  • "Client" refers to a User who has entered into a paid services agreement with AuditStream AI.
  • "Report" means any compliance analysis, audit report, or documentation deliverable produced by AuditStream AI under a paid engagement.

2. Acceptance of Terms

By accessing or using the Website or any of our Services, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using our Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not use our Website or Services.

These Terms apply to all users, including visitors, registered users, and Clients.

3. Description of Services

AuditStream AI provides technical compliance tooling to help organisations understand and address their obligations under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689) and related data governance frameworks.

Our Services include:

  • Free Compliance Checker: A free online tool providing a preliminary EU AI Act risk classification based on user inputs
  • Readiness Scan: A one-time paid technical audit of an AI dataset including bias analysis, PII scanning, data governance review, and Article 11 documentation draft
  • Guard: A monthly subscription for continuous compliance monitoring of up to three AI models
  • Governance: An enterprise annual contract for organisations with multiple AI systems and complex compliance requirements

AuditStream AI reserves the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

4. Free Compliance Checker

⚠ Important: The Free Compliance Checker provides a preliminary indication only. It does not constitute legal advice. It does not establish a client relationship. The results should not be relied upon as a substitute for advice from a qualified legal professional.

The Free Checker is based on the official EU AI Act compliance flowchart maintained by the Future of Life Institute and aligned with European Commission guidance. It is provided free of charge as an informational service.

By submitting your contact details through the checker, you agree that:

  • AuditStream AI may send you your compliance results by email
  • AuditStream AI may follow up with you regarding its paid services
  • Your data will be processed in accordance with our Privacy Policy

The checker results are generated automatically and may not reflect the most current state of EU AI Act implementation guidance, national enforcement decisions, or your specific legal circumstances. Always consult a qualified lawyer for binding compliance advice.

5. Paid Audit Services

5.1 Engagement and Pricing

Paid Services are engaged via a separate written agreement or order form specifying the scope, deliverables, timeline, and price. No paid engagement is binding until confirmed in writing by AuditStream AI.

Prices are quoted in euros excluding Belgian VAT (where applicable). Payment terms are set out in the applicable order form or agreement.

5.2 Deliverables

AuditStream AI will deliver the agreed Reports within the timelines specified in the engagement agreement. Reports constitute technical documentation and analysis. They do not constitute legal advice or guarantee regulatory approval.

5.3 Client Obligations

To enable us to perform paid Services, the Client agrees to:

  • Provide accurate and complete information about the AI system and dataset to be audited
  • Grant read-only access to the data samples necessary for the audit
  • Respond promptly to reasonable requests for clarification
  • Not provide data that contains personal data beyond what is necessary for the audit, and to obtain any required consents or anonymisation before sharing

5.4 Cancellation

For one-time Readiness Scans: cancellation before work commences results in a full refund. Cancellation after work has commenced is subject to payment for work completed to date.

For subscription plans (Guard, Governance): either party may terminate with 30 days' written notice. No refund is provided for the current billing period.

6. Intellectual Property

6.1 AuditStream AI Property

All content on the Website — including text, design, software, methodology, tools, and branding — is the property of AuditStream AI or its licensors and is protected by Belgian and international intellectual property law. You may not reproduce, distribute, or create derivative works without our prior written consent.

6.2 Report Ownership

Upon full payment, the Client receives a non-exclusive, non-transferable licence to use the delivered Report for their own internal compliance purposes. The underlying methodology, tooling, and audit frameworks remain the property of AuditStream AI.

6.3 Client Data

All data, datasets, and materials provided by the Client for the purpose of an audit remain the sole property of the Client. AuditStream AI acquires no rights over Client data beyond what is necessary to perform the Services.

7. Disclaimer of Warranties

The Website and Free Checker are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied.

AuditStream AI does not warrant that:

  • The Website will be uninterrupted, error-free, or secure
  • The results of the Free Checker are accurate, complete, or legally binding
  • The Services will meet your specific compliance requirements
  • Any Report constitutes legal advice or guarantees regulatory compliance

EU AI Act obligations are complex, evolving, and subject to national implementation. The adequacy of any compliance approach depends on facts and circumstances specific to your organisation, which only a qualified lawyer can assess.

8. Limitation of Liability

To the fullest extent permitted by Belgian law, AuditStream AI's total liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the amount paid by you for the specific Service giving rise to the claim in the 12 months preceding the claim.

AuditStream AI shall not be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of profit, revenue, business, or anticipated savings
  • Regulatory fines or penalties imposed by any authority
  • Damages arising from reliance on Free Checker results

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Belgian law.

Belgian consumer protection law (Wetboek Economisch Recht / Code de droit économique) applies to the extent that Users qualify as consumers. These Terms do not affect statutory consumer rights.

9. Data and Confidentiality

Our handling of personal data is governed by our Privacy Policy.

For paid engagements involving the processing of Client personal data on behalf of the Client, a separate Data Processing Agreement (DPA) will be concluded prior to the commencement of work, as required by Article 28 GDPR.

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Services, and not to disclose such information to third parties without prior written consent, except as required by law.

10. Termination

AuditStream AI reserves the right to suspend or terminate access to the Website or Services with immediate effect if a User:

  • Violates these Terms of Service
  • Uses the Services for any unlawful purpose
  • Attempts to gain unauthorised access to our systems
  • Provides materially false information

Upon termination of a paid engagement, all licences granted under Section 6.2 remain in effect for Reports already delivered and paid for.

11. Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with Belgian law, without regard to its conflict of law principles.

Any dispute arising from or related to these Terms or the Services shall be submitted to the exclusive jurisdiction of the competent courts of Brussels, Belgium.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation for a period of 30 days following written notice of the dispute.

For Users who qualify as consumers under Belgian law, mandatory consumer dispute resolution options under the Code de droit économique / Wetboek Economisch Recht remain available, including the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms of Service from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes affecting active paid engagements, we will notify Clients by email at least 14 days in advance. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
